A Stockton City Council candidate has formally ended her campaign five days after prosecutors charged her with five felonies over claims that she used addresses where she did not live to qualify for the race.
Desiree Lynch was running for the District 5 seat when San Joaquin County prosecutors accused her of falsely registering to vote and filing candidate paperwork using Stockton addresses that did not reflect where she actually lived.
Investigators say one address Lynch identified as her residence was associated with Harry’s Cocktail Lounge. Another was an apartment at Doyle Garden Apartments. Prosecutors allege she was actually living in Lodi and North Stockton.
Lynch formally withdrew from the race Aug. 24, according to FOX40. Her exit followed a turbulent stretch in which she announced she was leaving the campaign, reversed that decision four days later and was arrested the following morning.
Prosecutors Say She Used Two Addresses to Establish District 5 Residency
The criminal case centers on whether Lynch actually lived in the council district she was seeking to represent. The San Joaquin County District Attorney’s Office says investigators determined that she used two Stockton addresses to establish residency in District 5 while actually residing in Lodi and North Stockton, which is within District 1.
The District Attorney’s Aug. 19 announcement identified one location as Harry’s Cocktail Lounge at 407 E. Charter Way, also known as East Martin Luther King Jr. Boulevard, and the other as Doyle Garden Apartments at 625 E. Oak Street.
There is a small discrepancy in the public records. A criminal complaint later obtained by Stocktonia lists Lynch’s first alleged residence as 409 rather than 407 in the same block. The District Attorney’s Office had not publicly explained the difference.
Three Filings Became Three Perjury Counts
A criminal complaint obtained by Stocktonia identifies three filings at the center of the perjury allegations. Prosecutors say Lynch signed voter registration paperwork under penalty of perjury on Nov. 10, 2025, using the Martin Luther King Jr. Boulevard address.
On Feb. 5, she allegedly filed another voter registration document listing the East Oak Street apartment. The third count concerns nomination and candidacy paperwork Lynch signed March 2 to run for the District 5 seat.
Two additional felony counts accuse her of knowingly registering to vote where she was not entitled to register and filing a false nomination paper or declaration of candidacy.
She Left the Race, Returned and Was Arrested the Next Morning
Lynch first announced Aug. 14 that she would stop campaigning, citing concerns involving her safety, health and family. Four days later, she reversed course and notified the city clerk that she intended to remain in the contest against incumbent Councilmember Brando Villapudua.
The following morning, Aug. 19, Lynch was arrested following a six-week investigation by the District Attorney’s Bureau of Investigations. She was booked on five felony counts with bail set at $100,000 and released on bond later that day.
On Aug. 24, Lynch submitted a signed letter withdrawing her candidacy effective immediately. Her attorney, Allen Sawyer, said she would focus on her daughter and family responsibilities while dealing with the criminal case.
Ending Her Campaign Does Not Remove Her From the Ballot
Lynch’s decision to stop campaigning does not appear to remove her name from the Nov. 3 general election ballot. When she first announced her withdrawal, Stockton’s interim city clerk said her name would remain because she had already advanced from the June primary.
California Elections Code generally prevents a candidate nominated at a primary from withdrawing from the ensuing general election except under limited statutory circumstances.
Lynch’s Aug. 24 letter asked the city clerk to remove her name from consideration “as permitted by law,” but the latest reporting did not indicate that election officials had authority to grant that request.
Lynch and Villapudua advanced from the June 2 primary after Villapudua received 1,173 votes and Lynch received 1,054, a difference of 119 votes.
She Faces Up to Six Years and Eight Months if Convicted on All Counts
Lynch is scheduled to be arraigned Sept. 2 in San Joaquin County Superior Court. The District Attorney’s Office says the five felony counts carry a combined maximum sentence of six years and eight months in state prison if she is convicted on all of them.
Her release conditions include pretrial monitoring, restrictions on leaving California without court approval and a prohibition on possessing firearms or other deadly weapons while the case is pending. The charges remain allegations. Lynch has not been convicted, and prosecutors will have to prove the case in court.
California Has a Formal Process for Reporting Suspected Election Fraud
People who believe they have evidence of false voter registration, candidate filings or another election-related violation do not need to conduct their own investigation.
The California Secretary of State accepts election fraud complaints through its Investigative Services unit. The state’s complaint form asks for specific facts such as dates, locations and potential witnesses so authorities can determine whether an Elections Code violation should be investigated.
Suspected violations can also be reported to county election officials or local law enforcement. The San Joaquin County District Attorney specifically asks people with information about election fraud to contact its Bureau of Investigations or Public Integrity Unit.
